By accessing or using www.famictech.com or any other website, webpage, online portal, or subdomain operated or made available by Famic Technologies Inc. (collectively, the “Famic Website”), the user (“User”, “you” or “your”) agrees to be bound by this Privacy Policy. Your use of a particular Famic Website, service, or online portal may also be subject to additional terms and conditions specific to that website, service, or online portal. In the event of any conflict between this Privacy Policy and such specific terms and conditions, the applicable specific terms and conditions shall govern with respect to the relevant matter.

Famic Technologies Inc. (“Famic”, “we”, “us”, or “our”) may amend or update this Privacy Policy from time to time by publishing the revised version on the applicable Famic Website.

The use of information, services or the downloading for use of any material or information available on the Famic Website is done at your own risk. You agree that you will be solely responsible for any direct or indirect damage resulting from the use of this information, services, material, etc. Famic assumes no liability for any damages whether direct or indirect resulting from the use of information, services, material, etc. available on the Famic Website. No advice or information, whether oral or written, obtained by you directly from Famic or via the Famic Website, services or materials shall create any warranty not expressly stated in the Terms of Use and Conditions. Famic will not be liable for any loss whatsoever that you may incur, directly or indirectly, as a result of someone else using your credentials with respect to the Famic Website or any services or materials, either with or without your knowledge.

Online Tools

Access to certain tools on the Famic Website is possible without the need for your credentials, such as but not limited to the calculators (hereafter “Online Tools”), which have their own Terms and conditions that you will need to accept to use said Online Tools.

Online Services

Specific areas of the Famic Website require credentials to gain access, namely but not limited to the Client Zone, Store, Downloads, some of the Online Manufacturers’ Catalogues, etc. (collectively the “Online Services”).

Registration and Credentials. You agree to provide accurate and current information about yourself as required by the relevant registration process, and to promptly update such information as necessary to ensure that it is kept accurate and complete.

The credentials are for your exclusive personal use. You agree not to share them with anybody else. You agree to be responsible for maintaining the confidentiality of the credentials which you choose or are assigned as a result of any registration over the Famic Website for all activities that occur under such Credentials or account. Furthermore, you agree to notify Famic of any unauthorized use of your account.

Rules and Conduct. You recognize and acknowledge that Famic makes available Online Services to the Users to facilitate the exchange of information with its customers related to its Products and services.

In consideration of the availability, and your use, of the services, you agree, while using Online Services, not to post, transmit, link to, or otherwise distribute any information constituting or encouraging conduct that could become a criminal offense or give rise to civil liability. You agree not to post or distribute any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful material or information; post, transmit, link to, or otherwise distribute any information or software which contains a virus, worm or other harmful or disruptive component; defame, abuse, stalk, harass, threaten or otherwise violate the legal rights of others, including without limitation, rights relating to privacy and publicity.

You further agree that Famic shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with your use of, or reliance on, any such content.

Service Modifications. You acknowledge and agree that Famic reserves the right at any time to modify or discontinue any access to Online Services with or without any notice.

Termination. You acknowledge and agree that Famic, in its sole and absolute discretion, may, without notifying you, suspend or terminate your account, your use of, or your access to Online Services, and remove and discard any information or content related to it if Famic believes that you have violated any of the present Terms and Conditions. You further agree that Famic shall not be liable directly or indirectly to you or to any other person as a result of any such suspension or termination.

Disclaimer of Warranties. The Famic Website may offer additional services and tools which may have their own terms and conditions relating to the collection of your information. You will have to review those terms and conditions and accept them in order to be able to use the said tools and services.

No License, Intellectual Property and Others

Famic owns the intellectual property of its Famic Website. The content available through the Famic Website is protected by copyright, trademark, patent or other rights of Famic. You agree not to copy in whole or in part, adapt, translate, modify any content without Famic’s prior written authorization. You also agree not to copy, adapt, translate, modify, decompile, disassemble or reverse engineer any applications, programs or software available through the Famic Website. Furthermore, you agree not to modify, alter, or deface any of the trademarks, service marks, or other intellectual property.

  • Share malware, viruses, or any harmful content.
  • Engage in illegal activities or promote unlawful behaviour.
  • Use the Chat for advertising, solicitation, or commercial purposes without permission.

Moderation and Monitoring

  • The Chat may be monitored by administrators to ensure compliance with these terms.
  • Famic reserves the right to remove any content deemed inappropriate or in violation of these terms.
  • Repeated violations may result in temporary or permanent suspension of access.

Privacy and Data Protection

  • Any personal data shared within the Chat is done at the User’s discretion.
  • The Chat will handle user data in accordance with Famic Data Governance Statement.

Governing Laws

This Privacy Policy for Famic Website shall be construed and governed in accordance with the laws of the Province of Quebec, Canada. User consents to the exclusive jurisdiction of the courts of the District of Montreal (Quebec), Canada.
